Verfassung
§1
Der Rat für die Künste ist die gewählte Interessenvertretung der in Berlin im Kulturbereich aktiv tätigen kulturellen und künstlerischen Institutionen, Gruppen, Formationen und der Kulturwirtschaft gegenüber Land, Kommune und Bund. Er besteht aus 19 gewählten Ratsmitgliedern, die in leitender Funktion die gesamte kulturelle Landschaft Berlins und ihre Verfasstheit (Staatsbetrieb, institutionell geförderte Einrichtungen, freie Formationen, Kulturwirtschaft) repräsentieren, und maximal 5 berufenen Einzelpersonen. Der Rat für die Künste befasst sich mit allen relevanten, das kulturelle Leben Berlins betreffenden Fragen, sucht die Öffentlichkeit und berät die Politik und andere gesellschaftliche Gruppen in Bund, Land und Kommune. Der Rat für die Künste hat seinen Sitz in Berlin und tagt an wechselnden Orten.
§2
Die Gremien des Rates für die Künste sind:
1. Die Vollversammlung aller Kulturschaffenden in Berlin
2. Der Rat der gewählten Mitglieder (Rat für die Künste)
3. Die zwei Sprecher*innen des Rates für die Künste.
§3
Wahl und Arbeitsweise des Rates für die Künste
Die Wahl der Ratsmitglieder des Rates für die Künste erfolgt aller zwei Jahre auf Vorschlagsbasis durch die Vollversammlung aller Kulturschaffenden.
Ein Ratsmitglied ist gewählt, wenn es die einfache Mehrheit der bei der Vollversammlung Anwesenden erhält.
Die 19 Ratsmitglieder wählen aus ihrer Mitte die beiden Sprecherinnen/Sprecher sowie eine Geschäftsführung. Die beiden Sprecherinnen/Sprecher repräsentieren den Rat für die Künste nach außen und führen die Verhandlungen.
Zu seiner Ergänzung und Verstärkung kann der Rat bis zu fünf Persönlichkeiten als Ratsmitglieder nachberufen.
Die Mitglieder des Rates geben sich selbst einen Rhythmus für ihre Sitzungen und bestimmen die Tagesordnung. Termine und Tagesordnung der Sitzungen werden durch die Geschäftsführung des Rates für die Künste umgesetzt.
Die Vertretung eines Ratsmitglieds für den Fall, dass dieses an einer Sitzung des Rates nicht teilnehmen kann, ist ausgeschlossen. Der Rat entscheidet, ob seine Sitzungen für Gäste offen sind.
Alle Teilnehmer*innen der Vollversammlung können fortlaufend Vorschläge zur Tagesordnung des Rates für die Künste machen. Es besteht jedoch kein Anspruch auf Behandlung der vorgeschlagenen Themen durch die gewählten Mitglieder des Rates.
Der Rat für die Künste kann zu speziellen Fragen Arbeitsgruppen berufen und Fachtagungen initiieren. Die Arbeitsgruppen haben das Recht, sich zusätzlichen Sachverstand einzuholen und/oder sich durch Berufung ratsexterner Experten fachlich zu verstärken.
Scheidet ein Ratsmitglied innerhalb der Legislaturperiode aus dem Rat für die Künste aus, beruft der Rat der gewählten Mitglieder aus der für die Legislaturperiode zusammengestellten Wahlliste einen Kandidaten der gleichen Kategorie nach.
Nach Bedarf, jedoch mindestens ein Mal im Jahr, beruft der Rat für die Künste die Vollversammlung ein, berichtet über die Arbeit und diskutiert anfallende Probleme. Die Vollversammlung kann dem Rat per Beschlussfassung grundlegende Themen zur weiteren Bearbeitung aufgeben.
Verfassungsänderungen können von einer Vollversammlung mit 2/3 Stimmenmehrheit der Anwesenden vorgenommen werden. Anträge auf Änderung der Verfassung müssen schriftlich beim Rat für die Künste eingereicht und von diesem auf die Tagesordnung der nächsten Vollversammlung gesetzt sowie mit der Einladung zur „Vollversammlung aller Kulturschaffenden“ weitergeleitet werden.
Über eine Auflösung des Rates für die Künste kann nur mit einer Mehrheit von 2/3 der Stimmen der Anwesenden bei der Vollversammlung beschlossen werden.

Constitution
§1
The Council for the Arts is the elected body representing the interests of the cultural and artistic institutions, groups, formations, and cultural industry active in Berlin with respect to the municipalities, Land, and federal state. It is composed of 19 elected council members which, in leading positions, represent Berlin’s entire cultural landscape and its various organisational forms (state owned, institutionally sponsored facilities, independent formations, culture industry) and a maximum of 5 appointed individuals. The Council for the Arts addresses all issues relevant to Berlin’s cultural life, conducts public relations work, and advises politics and other social groups at the municipal, Land, and federal government level. The Council for the Arts has its headquarters in Berlin and convenes at alternating locations.
§2
The Council for the Arts’s committees are:
1. The General Assembly of all persons in Berlin active in the cultural sector
2. The council of elected members (Council for the Arts)
3. The Council for the Arts’s two spokespersons.
§3
Election and working method of the Council for the Arts
The Council for the Arts’s council members are elected every two years by the General Assembly of all cultural practitioners on the basis of nominations.
A council member is elected when they receive the simple majority of the votes of those present at the General Assembly.
The 19 council members elect the two spokespersons from their ranks as well as a Management Board. The two spokespersons represent the Council for the Arts in external matters and conduct the negotiations.
For the purpose of strengthening and supplementing the council it is entitled to appoint up to five individuals as council members.
The members of the council decide upon the frequency of their meetings and set the agenda. The dates and agendas for the meetings are implemented by the Council for the Arts’s Management Board.
In the event that a council member is unable to attend a meeting of the council, they are not permitted to send a proxy to represent them. The council decides whether a meeting is to be opened to guests.
All those attending the General Assembly can make suggestions for the Council for the Arts’s agenda. However, the elected members of the council are not beholden to address the proposed themes.
The Council for the Arts can convene working groups on special issues and initiate symposia. The working groups have the right to call on additional expertise and/or strengthen their technical competence through the appointment of external experts.
If a council member resigns from the Council for the Arts within the legislature period, the council of elected members appoints a candidate of the same category from the list of candidates compiled for the legislature period.
According to need, however at least once per year, the Council for the Arts convenes the General Assembly, reports on its work and discusses current problems. The General Assembly can instruct the council, via resolution, to address fundamental themes.
Changes to the constitution require a two thirds majority of the votes of all those attending the General Assembly. Resolutions for changes to the constitution must be submitted to the Council for the Arts in writing which must place it on the agenda of the next General Assembly and include it in the invitation to the “General Assembly of all Cultural Practitioners”.
The dissolution of the Council for the Arts requires a two thirds majority of the votes of all those attending the General Assembly.
